3. Professional fees
Under Article 9 of Italian Decree-Law No. 1 of 24 January 2012, converted with amendments by Law No. 27 of 24 March 2012, professional fees are not subject to binding tariffs. Fees are agreed in the engagement, subject, where applicable, to Law No. 49 of 21 April 2023 on fair remuneration and the provisions governing public contracts. A preliminary written quotation is provided before the engagement begins.
Private clients: court assessment of fees
Where fees are assessed by a court, the parameters in Italian Ministerial Decree No. 140 of 20 July 2012 apply. The decree sets the criteria and methods for assessing engineers' fees and was published in the Italian Official Gazette No. 195 of 22 August 2012.
Public clients: engineering and architecture services
For engineering and architecture services commissioned by public contracting authorities, the fees forming the tender basis are determined under Annex I.13 to Italian Legislative Decree No. 36 of 31 March 2023 (the Public Contracts Code), as amended. For each category of works and service, the calculation considers the value of the works (V), the degree of complexity (G), the parameter for the specific service (Q) and the base parameter (P), according to the tables and rules referred to by the legislation.
